These Terms and Conditions govern your use of the UTIKHA mobile application.

By downloading, installing, accessing, or using UTIKHA, you agree to these Terms.

If you do not agree with these Terms, you should not use the application.

1. About UTIKHA

UTIKHA is a casual mini-game application designed for short gameplay sessions.

The application may include games involving reaction, rhythm, attention, memory, timing, or similar gameplay mechanics.

UTIKHA is provided for entertainment purposes.

No account or registration is required; basic free features work without signing in. UTIKHA's current release is for iOS only.

2. License to Use the Application

You are granted a limited, personal, non-exclusive, and non-transferable license to use UTIKHA in accordance with these Terms and applicable law, subject to Section 14.

3. UTIKHA Premium

Premium is intended as a one-time, non-consumable purchase, not a subscription, and has no automatic renewal or recurring charges. It unlocks the Premium features identified in the app. Apple App Store processes payment. “Lifetime” means for as long as UTIKHA makes the relevant Premium feature available; it does not promise perpetual operation, updates, or support. The current release is for iOS only; Android is not currently being released, and no cross-platform transfer of Premium is promised. If the feature is changed, withdrawn, or does not conform to applicable requirements, any mandatory consumer rights and remedies remain available.

All payments are processed by the platform from which you obtained the application, including:

UTIKHA does not directly process your payment card information.

Prices may vary by country, currency, taxation, and app store pricing rules.

The price shown by the applicable app store at the time of purchase is the price that applies to the transaction.

5. Restoring Purchases

Eligible non-consumable purchases may be restored using the Restore Purchases feature.

Purchase restoration depends on the Apple account used for the original purchase and Apple's rules.

You may need to use the same store account that originally completed the purchase.

6. Refunds

Refund requests are handled by the store through which the purchase was made.

For purchases made through Apple App Store, Apple's refund rules apply.

UTIKHA does not independently control the approval or rejection of store refund requests.

If a purchase is refunded, revoked, or otherwise invalidated by the store, access to corresponding Premium features may also be revoked.

Store refund procedures do not limit any mandatory consumer rights or remedies available under applicable law, including rights relating to digital content.

We aim to keep UTIKHA available and functional, but uninterrupted availability is not guaranteed.

Eligible purchases can be restored under store rules. Game results are stored locally; uninstalling or clearing app data may erase them, and cloud sync is not promised.

UTIKHA, including its software, interface, graphics, branding, game designs, text, and other original content, is protected by applicable intellectual property laws.

12. Disclaimer

UTIKHA is provided on an "as is" and "as available" basis to the extent permitted by law.

We do not guarantee that:

UTIKHA is intended for entertainment and should not be treated as a medical, psychological, diagnostic, therapeutic, or professional assessment tool.

13. Limitation of Liability

To the maximum extent permitted by applicable law, the developer will not be liable for indirect, incidental, special, consequential, or similar damages arising from your use of or inability to use UTIKHA.

Nothing in these Terms limits rights or remedies that cannot legally be excluded under applicable consumer protection laws.

You may stop using UTIKHA at any time.

Access to the application may be limited or terminated if the application is used unlawfully or in serious violation of these Terms.

15. Governing Law

These Terms are governed by applicable law, subject to mandatory consumer protection rights that may apply in your country or region.

Nothing in these Terms removes rights that you are legally entitled to under local consumer protection law.

16. Changes to These Terms

These Terms may be updated as UTIKHA evolves.

The latest version will be published on the official UTIKHA website with an updated effective date.
